The terms that govern your use of birdzeye.org, our voice assistant, and our messaging channels.

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your use of birdzeye.org, our phone line, our chat widget, and any related services operated by Birdzeye Inc. (“Birdzeye,” “we,” “us,” or “our”). By using the site or contacting us through it, you agree to these Terms. If you do not agree, please do not use the site.

2. Who We Are — and What We Are Not

Birdzeye Inc. is a real estate acquisition company located at 15025 Lancaster Hwy, Suite D4, Charlotte, NC 28277. We purchase land and fix-and-flip properties directly, using our own capital, and we may resell property we own to builders and buyers.

We are not a licensed real estate brokerage and we do not provide brokerage services. We do not list properties, we do not represent buyers or sellers, and we do not act as your agent or fiduciary. When we discuss a property with you, we are acting as a principal for our own account, with our own interests. We do not provide legal, tax, financial, appraisal, or investment advice. You are encouraged to consult your own attorney, accountant, or licensed advisor before entering into any transaction.

3. Use of the Site

You agree not to:

  • Use the site for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, or fraudulent information, or information about a property you have no authority to discuss
  • Submit another person’s phone number or contact information without their permission
  • Scrape, harvest, or use automated means to collect data from the site
  • Attempt to interfere with, disrupt, or gain unauthorized access to the site or our systems

4. Property Inquiries, the Voice Assistant & Appointments

When you call +1 (704) 756-0576, your call is answered first by an automated AI voice assistant. The assistant collects the property address, your contact details, and basic information about your situation. It is software — it does not negotiate, it does not make offers, and nothing it says binds Birdzeye Inc..

After that, a member of our team follows up personally, by appointment, to review the property and discuss terms. Calls may be recorded and transcribed as described in our Privacy Policy.

Submitting the contact form or calling us creates no obligation on either side. It is a request for us to look at a property.

5. No Offer or Contract Until Signed in Writing

Any price, range, estimate, timeline, or term discussed on this website, by the voice assistant, by text, by email, or in conversation is preliminary and non-binding. It is an indication of interest only.

No offer is binding and no agreement to buy or sell exists unless and until both parties sign a written purchase agreement. Any offer we make is subject to inspection, title review, survey, and our due diligence, and may be revised or withdrawn at any time before signing. We make no guarantee that we will make an offer on any property.

6. Electronic Communications, Calls & SMS

By providing your contact information, you agree that we may contact you about your inquiry by phone and email, including at the number and address you provide.

Text messages are separate and optional. We send SMS only if you affirmatively check the SMS consent box, which is never pre-checked, and consent to receive texts is not a condition of any purchase, sale, or service. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Full details, including how we store and honor consent, are in section 3 of our Privacy Policy.

You consent to receive notices and disclosures from us electronically, and agree that electronic communications satisfy any legal requirement that such communications be in writing.

7. Accuracy of Information You Provide

You represent that information you give us is accurate and that you have the authority to discuss and, if applicable, sell the property you contact us about. If you are one of several owners, an heir, an executor, or acting under a power of attorney, tell us — it affects what we can do and how quickly.

8. Intellectual Property

The site, its content, design, and the Birdzeye name and logo are owned by Birdzeye Inc. and protected by intellectual property laws. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, or create derivative works from the site without our written permission.

9. Third-Party Services

The site uses third-party services, including a signup form provided by R35 and hosting and database infrastructure operated by our vendors. Their availability and behavior are outside our control, and your use of them may be subject to their own terms.

10. Disclaimers

The site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any information on it is complete, current, or accurate.

Nothing on this site is a guarantee of any outcome, offer, price, closing, profit, or return.

11. Limitation of Liability

To the fullest extent permitted by law, Birdzeye Inc. and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunities, arising out of your use of the site or your communications with us — even if we were advised such damages were possible. Our total liability for any claim relating to the site will not exceed one hundred dollars ($100.00). Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold Birdzeye Inc.harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the site, your violation of these Terms, or your submission of information you had no right to submit — including another person’s phone number.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or your use of the site will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to their jurisdiction.

14. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and Fulfillment Policy, are the entire agreement between you and us regarding the site. A signed purchase agreement, if one exists, governs that transaction.

15. Changes to These Terms

We may update these Terms. Changes take effect when posted, and the effective date at the top of this page will be updated. Continuing to use the site after a change means you accept the revised Terms.
