1. Who We Are
Birdzeye Inc. (“Birdzeye,” “we,” “us,” or “our”) is a real estate acquisition company located at 15025 Lancaster Hwy, Suite D4, Charlotte, NC 28277. We purchase land and fix-and-flip properties directly in Charlotte, North Carolina and the surrounding markets.
This Privacy Policy explains what information we collect through birdzeye.org, our phone line, and our messaging channels; how we use it; and the choices you have. It applies to all visitors, callers, and people who submit information to us.
2. Information We Collect
2.1 Information you give us
- Contact details — your name, phone number, and email address.
- Property information — the address or parcel identifier, condition, occupancy, timeline, and anything else you choose to tell us about a property.
- Communications — the content of messages, form submissions, chat conversations, and phone calls with us.
- Consent records — whether you opted in to text messages, the date and time you did, the exact disclosure text you were shown, and the page you submitted it from.
2.2 Information collected automatically
- IP address, browser type, device type, referring page, and the pages you view on our site.
- Cookies and similar technologies used by our website host and our chat widget provider to keep the site working and to understand general usage.
2.3 Information from public and third-party sources
For properties you ask us to evaluate, we review publicly available records — county tax and parcel data, deeds, plats, zoning records, and comparable sales. This is standard due diligence on the property itself.
3. SMS & Communication Consent (TCPA Compliance)
This section describes how we handle phone calls and text messages. It is written to comply with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and mobile carrier A2P 10DLC requirements.
3.1 No Automatic SMS Consent
Submitting a form on birdzeye.org or providing your phone number does not by itself sign you up for text messages, and it does not constitute consent to marketing messages of any kind.
SMS consent is collected through a separate, optional checkbox that is never pre-checked. You must affirmatively check it. Your inquiry is accepted and handled exactly the same whether or not you check it — we will simply contact you by phone or email instead. Consent to receive text messages is not a condition of purchasing any goods or services, of selling property to us, or of any other transaction.
When you do opt in, we record the date and time, the exact wording of the disclosure displayed to you, the version of that disclosure, the page you submitted from, and your IP address, so that we can demonstrate what you agreed to.
3.2 Service-Related Communications
If you opt in, the text messages we send relate to your own inquiry and our business relationship with you. They include:
- Appointment reminders and scheduling confirmations
- Confirmations that we received your inquiry or documents
- Offer, due diligence, and closing status updates
- Requests for information we need to evaluate a property
- Customer care responses to questions you send us
Separately from SMS, we may contact you by phone call or email in response to an inquiry you submit, because responding to your request is the reason you contacted us.
3.3 How to Opt Out
- Text messages: reply STOP to any message from us. You will receive one confirmation message and then no further texts. Reply START or UNSTOP to opt back in. Reply HELP for assistance.

Opt-out requests are honored promptly. We may still contact you about an active transaction using another method you have provided, and we maintain an internal do-not-contact list to make sure your request sticks.
3.4 Call Recording
Calls to +1 (704) 756-0576 are answered by an automated AI voice assistant that collects your property details and contact information before a member of our team follows up personally. Calls may be recorded, transcribed, and stored for quality assurance, training, and accuracy of the information you give us. If you do not wish to be recorded, tell the assistant or hang up and contact us instead by email at info@birdzeye.org or through our contact form.
3.5 Mobile Information and Third Parties
We do not sell, rent, or share your mobile opt-in information or phone number with third parties or affiliates for marketing purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Text messaging originator opt-in data and consent are not shared with any third party other than the service providers that operate our messaging and customer-relationship systems on our behalf, strictly to deliver the messages you asked for. Those providers are contractually prohibited from using your information for their own purposes.
3.6 Message Frequency, Rates & Help
- Message frequency varies based on your activity and the stage of your inquiry. There is no fixed number of messages.
- Message and data rates may apply. Your mobile carrier may charge you for messages sent or received; we do not control those charges.
- Carriers are not liable for delayed or undelivered messages.

- Supported carriers may change without notice. Message delivery is subject to carrier availability.
4. How We Use Your Information
- To evaluate a property you ask us to look at and prepare an offer
- To contact you about your inquiry and schedule appointments
- To carry out and close a transaction you enter into with us
- To match builders and buyers in our network with parcels we own, when they have asked us to
- To keep records required by law, including consent records
- To operate, secure, and improve our website and phone systems
- To detect and prevent fraud and abuse
We do not use your information for automated decision-making that produces legal effects about you, and we do not build advertising profiles from it.
5. How We Share Your Information
We do not sell your personal information. We share it only in these situations:
- Service providers — the vendors that run our website hosting, database, phone system, and customer-relationship and messaging platform. They act on our instructions and may not use your information for their own purposes.
- Transaction participants — if you proceed with a transaction, the closing attorney, title company, surveyor, lender, or escrow agent involved in that specific transaction.
- Legal requirements — when required by law, subpoena, or court order, or to protect our rights, safety, or property.
- Business transfer — in connection with a merger, acquisition, or sale of assets, subject to this policy.
As stated in section 3.5, mobile opt-in data and phone numbers are never shared for third-party or affiliate marketing.
6. Cookies, Analytics & Our Chat Widget
We use cookies and similar technologies that are necessary for the site to function and to understand aggregate usage. Our website includes a chat form that we operate ourselves; the name, mobile number and message you enter there are sent directly to us and stored in our own database, and are treated the same as any other message you send us. The site also embeds a signup form provided by R35, the platform our voice and chat assistants run on, which may set its own cookies.
Most browsers let you refuse or delete cookies through their settings. Blocking cookies may affect how parts of the site work.
7. Data Retention
We keep inquiry information for as long as needed to respond to you and for our legitimate business and recordkeeping needs. Because federal rules require us to be able to prove consent, we retain SMS consent and opt-out records for at least four (4) years after the consent is given or withdrawn, even if you ask us to delete other information. Transaction records are kept as long as required by North Carolina and federal law.
8. Security
Information you submit is transmitted over an encrypted connection and stored in access-controlled systems. No method of transmission or storage is perfectly secure, so we cannot guarantee absolute security, but we take reasonable technical and organizational measures to protect your information.
9. Your Choices & Rights
- Access and correction — request a copy of the information we hold about you, or ask us to correct it.
- Deletion — ask us to delete your information, subject to the consent and transaction records we are required to keep.
- Communication preferences — opt out of texts, calls, or emails at any time using the methods in section 3.3.
- Do Not Call — tell us to add your number to our internal Do Not Call list and we will not call you again for solicitation purposes.

10. Children’s Privacy
Our site and services are intended for adults. We do not knowingly collect information from anyone under 18. If you believe a minor has given us information, contact us at info@birdzeye.org and we will delete it.

Our site may link to sites we do not operate. We are not responsible for their content or privacy practices. Review their policies before providing information to them.
12. Changes to This Policy
We may update this Privacy Policy. When we do, we will change the effective date at the top of this page. If we make a material change to how we handle SMS consent, we will obtain new consent where required rather than relying on the old one.
